1) About OpenCourt
OpenCourt is an information and community platform that helps players discover public courts, view and share reviews, and plan bookings. We do not operate, manage, or endorse any courts, and we are not affiliated with ClubSpark/LTA or any council or venue operator. We do not make bookings for you, and we do not take payment on behalf of any venue.
2) Your Account & Eligibility
- You must be 16+ to use OpenCourt. If you are 16–17, you confirm you have permission from a parent/guardian.
- To limit spam, you must sign in to post reviews or upload content. You agree to keep your credentials confidential and are responsible for activity on your account.
- To close or delete your account, email bunoujr@gmail.com.
3) Acceptable Use
You may use OpenCourt only for lawful purposes. You agree not to:
- scrape, crawl, bulk-download, or reverse engineer the service or its data;
- bypass any access or rate limits;
- upload or post content that is unlawful, defamatory, discriminatory, obscene, misleading, promotional spam, or that infringes third-party rights;
- misuse ratings/reviews (e.g., non-genuine, paid, or coordinated manipulation).
We may throttle, suspend, or terminate accounts that breach these Terms.
4) Reviews & User Content
- You keep ownership of your content.
- By submitting content (text, images, ratings), you grant OpenCourt a worldwide, non-exclusive, royalty-free licence (with the right to host, reproduce, modify for formatting, and display) solely to operate, improve, and promote the service.
- You represent that you have the rights to post the content and that it is accurate to the best of your knowledge.
- We may moderate, hide, or remove content that violates these Terms or applicable law.
5) Court Information & Third Parties
Court availability, prices, and facility details are for convenience only and may be incomplete, delayed, or inaccurate. Always verify directly with the venue before travelling or booking. OpenCourt is not a party to any booking and is not responsible for third-party services, policies, charges, or disputes.
6) Automated Tools & Future Features
Some features may be experimental (“beta”). Any automated booking or payment tools introduced later will be governed by additional terms which you must accept before use. We do not currently process payments for users.
7) Availability & Changes
We aim for a reliable service but do not guarantee uninterrupted access or error-free operation. We may update, suspend, or discontinue features at any time. Where reasonable, we’ll give notice of changes with material impact.
8) Intellectual Property
The OpenCourt website, apps, logos, and underlying software are owned by us or our licensors and are protected by law. Apart from the limited rights granted in these Terms, no licence is granted to you. Do not use our marks without prior written consent.
9) Indemnity
You agree to indemnify and hold harmless OpenCourt from claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your content; (b) your breach of these Terms; or (c) your misuse of the service.
10) Disclaimers & Liability
OpenCourt is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties (express or implied), including accuracy, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, we are not liable for: (i) lost profits, lost data, or indirect/consequential damages; and (ii) any amount exceeding £50 or the total you have paid to us in the past 12 months (whichever is greater). Nothing limits liability for fraud, death or personal injury caused by negligence, or other liability that cannot be excluded under law.
11) Termination
You may close your account at any time by contacting us. We may suspend or terminate your account or access if you breach these Terms or if required by law. Copies of content may persist in backups for a limited period for security or legal compliance.
12) Changes to these Terms
We may update these Terms from time to time. We will post the new effective date and, for material changes, provide reasonable notice. Your continued use after changes take effect constitutes acceptance.
13) Governing Law
These Terms and any non-contractual obligations are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
